The Judge ruled that “if the applicant had been injured while playing a game of cards in her motel room she would be entitled to compensation” and the fact that the woman was engaged in sexual activity rather than some other lawful recreational activity while in her hotel room does not lead to any different result.



How does that not make sense?

Yeah, the sex seems to be completely irrelevant to the actually case. It's not like she was a hooker and was filing for compensation for damages cause by the sex. Her actions had nothing to do with the accident. If she had been sleep and the light fixture had fallen on her how would this be any different?

My thoughts too Robert. She deserves compensation but you'd have thought the dodgy light fitting is primarily their responsibility. Unless she claimed against both, it doesn't say.

Perhaps the employer then sued the hotel?

The only thing that's a bit off would be that chain of claims, if indeed that's what happened.

But either way, compensation seems entirely justified.

If you work and travel for a large corporation they buy insurance to take on liability for injuries during travel. That covers if you're visiting customer facilities, car accidents, or falling hotel lighting. It's just something that's covered automatically as the corporations don't want to be in lawsuits, and they need to protect their people. The company would then think about suing the hotel in turn. They don't want their employees having to deal with that shit if they were on a work trip.

Yeah except if they were insured and trying to make life easier for their employees then presumably she wouldn't be suing them so these guys don't seem to have been that prepared.

I've spent large parts of the last 11 years travelling for large corporations and I'm very aware of my health, travel and accident coverage and the claims procedure and if a light fitting fell on my head I wouldn't need to venture into a federal court.

It's a very deliberate headline choice isn't it. "Hotel guest injured during sex gets compensation payout" implies a very different story; it's the conjunction of 'sex' and 'worker' that sets you on a different path.
